Article 1. Purpose

These General Terms of Use (hereinafter "General Terms of Use") detail the rights and obligations of the company CAMILLE & CLEMENTINE SAS, registered with the Paris Trade and Companies Register under number 832 784 706, with its registered office at 91 rue du Faubourg Saint Honoré 75008 Paris (hereinafter "Les Petits Prödiges", "we", "our") and of any user of the website (hereinafter the "User", "you") at the following address: https://lespetitsprodiges.com/ (or any other address replacing it or referring to it, hereinafter the "Site").

The Site is published by Les Petits Prödiges. As a User of the Site, you undertake to comply with these General Terms of Use.

Terms capitalized in these General Terms of Use and not defined below have the meaning given in the General Terms and Conditions of Sale.

Article 2. Definitions

The purpose of this clause is to define the various essential terms of the General Terms of Use:

"General Terms of Use": has the meaning defined in Article 1;

"General Terms and Conditions of Sale": means the general terms and conditions of sale of Les Petits Prödiges accessible via the following link: General Terms and Conditions of Sale

"Content(s)": has the meaning defined in Article 6;

"Personal Space": means the personal space opened free of charge in the User's name during registration on the Site, allowing access to the functionalities described below in Article 7;

"Site": has the meaning indicated in Article 1;

"User": has the meaning indicated in Article 1.

Article 3. Access to the site

Access to and use of the Site is reserved for any adult or any person holding parental authorization. Access to the Site is free. The Site is accessible to any User with internet access. All costs related to accessing the Site remain the responsibility of the User.

Article 6. Publication of online reviews

The Site allows any User to publish reviews on Les Petits Prödiges Products, as well as to upload photos (hereinafter collectively the "Content").

By publishing Content on our Site, you declare and warrant:

  • That the Content complies with the General Terms of Use;
  • That you are the author of this Content and that you are not misrepresenting yourself or using the identity of a third party;
  • That your Content is original and does not infringe the intellectual property rights of a third party or the intellectual property provisions described in Article 12 below;
  • That your Content is accurate and truthful;
  • That your Content does not contravene applicable laws and regulations and does not contain any hateful, discriminatory, racist, pornographic, political, or other remarks.

Les Petits Prödiges reserves the right, at its sole discretion, to modify, refuse, correct or delete any Content that Les Petits Prödiges considers to be in violation of these General Terms of Use, under the conditions provided for in Article 12.

Article 8. Personal account

If you wish to open a Personal Account, you must register by providing your Personal Data using the registration form. The Privacy Policy available here describes the collection carried out in this way.

In case of loss or forgotten password for accessing your Personal Account, you can at any time reset your login password by clicking on the "Forgot password?" tab and following the reset instructions provided by Les Petits Prödiges.

Any Personal Account is strictly personal and non-transferable. You agree to create and/or use only one Personal Account. The creation of a Personal Account under the identity of a third party or under a false identity is strictly prohibited and may result in the immediate suspension or deletion of your Personal Account.

The use of your Personal Account remains your sole responsibility.

Once your Personal Account is created, you can:

  • View your Order history;
  • Place orders for Products;
  • Manage your Personal Account (if applicable).

Article 9. User obligations

All costs necessary to access the Site (computer hardware, software, Internet connection, etc.) are and remain the responsibility of the User. As a User, you declare that you are fully aware of the characteristics of the Internet and the constraints related to its use, in particular the impossibility for Les Petits Prödiges to guarantee the integrity and confidentiality of all data transmitted over it.

You undertake to comply with all operating rules of the Site and your Personal Account and, more particularly, with these General Terms of Use.

In particular, you undertake to:

  • Not disclose or disseminate Content likely to harm the image of Les Petits Prödiges and/or any third party, and/or not comply with current legal and regulatory provisions;
  • Not use computer programs likely to disrupt, interrupt, destroy in whole or in part the Site.

You agree not to infringe our intellectual property rights, those of another User or a third party, nor to disseminate any confidential information or information whose dissemination would constitute a breach of a contractual commitment vis-à-vis Les Petits Prödiges, another User or a third party.

You waive all recourse against us in the context of proceedings initiated by a third party, or another User, due to the publication of any statement or Content, or due to any breach of the obligations arising from these terms.

You acknowledge that it is prohibited to perform any action likely to interrupt the operation of the Site, restrict its availability or prevent its continuity. Any intrusion, or attempt to intrude, into the Site, data misappropriation, infringement of the Site's security and authentication measures, gives rise to legal proceedings by Les Petits Prödiges against you.

You acknowledge that you use the data generated by the Site under your sole responsibility.

Article 10. Liability

Les Petits Prödiges is bound only by an obligation of means with regard to the provision of the Site and the services offered therein.

Les Petits Prödiges cannot be held liable:

  • In the event of failure, breakdown, difficulty, unavailability or interruption of operation, preventing access to the Site or one of its functionalities;
  • If you do not comply with the terms and conditions of use of the Site and/or the General Terms and Conditions of Sale of Les Petits Prödiges;
  • If you make abnormal use of your Personal Account.

You declare that you are aware that the operation of the Site is partly based on information and Personal Data that you provide to Les Petits Prödiges. Consequently, Les Petits Prödiges cannot under any circumstances be held liable if the information and Personal Data you provide to Les Petits Prödiges are incomplete, outdated or erroneous.

Les Petits Prödiges shall in no event be liable to compensate for any indirect damages you suffer during the use of the Site and/or your Personal Account, and more generally, all damages that do not result exclusively and directly from a fault or negligence of Les Petits Prödiges.

Any serious breach by you of any of your commitments under these General Terms of Use, not remedied within fifteen (15) days from the receipt of a registered letter with acknowledgment of receipt or an email with acknowledgment of receipt from Les Petits Prödiges, entitles Les Petits Prödiges to suspend your Personal Account and/or to prohibit your access to the Site, without prejudice to any other damages that Les Petits Prödiges may claim. The letter or email will specify the alleged facts. In the event of clearly unlawful disturbance or infringement, the period for remedying the breach may be shorter.

Article 11. Modification of the terms of use

These General Terms of Use may be modified at any time, particularly due to legislative and/or regulatory changes.

Unless the modification requires your express acceptance, your continued use of the Site implies acceptance of the General Terms of Use.

Article 12. Intellectual Property

The Site and the functionalities offered therein are the full and exclusive property of Les Petits Prödiges, including the intellectual property rights pertaining thereto, subject to the rights of third parties. Unless otherwise stated, Les Petits Prödiges is the owner, or holds the exploitation rights pertaining thereto, of all trademarks and logos as well as all intellectual property rights relating to all elements, texts, graphics, videos, animations, used and/or available on the Site.

Les Petits Prödiges grants every user of the Site an indirect, limited, personal, non-transferable, and non-exclusive license for the purpose of using the Site under the conditions provided herein. Any other use is expressly excluded.

The content made available within the framework of the Site can only be used within this framework, without any right of commercial use, reproduction and/or distribution, and under the sole responsibility of the Site user.

You declare that you are the author of the Content you publish on the Site or that you hold the rights allowing you to publish them.

Consequently, you grant Les Petits Prödiges a non-exclusive, transferable, sublicensable, free-of-charge right of exploitation over all Content, as and when it is published on the Site, as well as a free, geographically unlimited license over all related intellectual property rights.

All intellectual property rights over the Content thus granted to Les Petits Prödiges include the right for Les Petits Prödiges to reproduce, represent, distribute, adapt, modify, use, translate, all or part of the Content in all countries, by all present and future processes and means, in any form whatsoever and on all media, including digital, known or unknown, foreseeable or unforeseeable as of the date hereof, in all languages, in all formats, known or unknown to date, within the framework of the services offered by the Site or in relation to the activity of Les Petits Prödiges, and for all purposes including commercial purposes.

This license is granted and accepted worldwide for a period of fifty (50) years.

You guarantee Les Petits Prödiges against any action, claim, demand, eviction whatsoever, by a third party, or another User, invoking an intellectual or industrial property right that the Content would infringe, or an act of unfair and/or parasitic competition. Consequently, you undertake to take personal responsibility for any claim and/or procedure, formulated against Les Petits Prödiges and which would be directly or indirectly related to the Content, subject of this license. To this end, you undertake to intervene voluntarily, if necessary, in all proceedings brought against Les Petits Prödiges on this basis.

Article 13. Hypertext links

The establishment by the User of any hypertext links to all or part of the Site is strictly prohibited, except with the prior written authorization of Les Petits Prödiges, requested by email at the following address: hello@lespetitsprodiges.com

Les Petits Prödiges is free to refuse this authorization without having to justify its decision in any way. In the event that Les Petits Prödiges grants its authorization, it is in all cases only temporary and may be withdrawn at any time, without any obligation of justification on the part of Les Petits Prödiges.

Les Petits Prödiges may include hypertext links on the Site to third-party websites.

Les Petits Prödiges cannot be held responsible for the operation and content of these third-party websites, and for any damage that may be suffered by any User during a visit to said sites.

Article 14. Site management

For proper management of the Site, Les Petits Prödiges reserves the right to:

  • Suspend, interrupt or limit access to the Site, or to certain parts of the Site;
  • Delete any information that may disrupt its operation or that is in violation of national or international laws;
  • Suspend the Site to carry out updates;
  • Modify the content of the Site at any time and without notice.

Article 16. Applicable law and competent jurisdiction

The General Terms of Use are subject to French law.

Article 17. Customer Service - Complaint

For any difficulties, the Customer should primarily contact Les Petits Prödiges customer service at the following email address:

In case of failure of the complaint request to Les Petits Prödiges customer service or in the absence of a response from this service within one (1) month, the Customer may submit the dispute to the following mediator: CMAP - Centre de Médiation et d’Arbitrage de Paris. You can refer the matter to the Mediator. To submit your dispute to the mediator, you can:
- fill in the form on the CMAP website: www.cmap.fr (consumer tab);
- send your request by regular or registered mail to CMAP Médiation Consommation, 39 avenue Franklin D. Roosevelt, 75008 PARIS.

The mediator will attempt, independently and impartially, to bring the Parties together to reach an amicable solution. To present their mediation request, the Customer can submit a request by directly contacting the mediator whose contact details are listed above.
