  1. Preamble

Welcome to the Les Petits Prödiges website (https://lespetitsprodiges.com/ or any other address that may be substituted for it, the “Site”), owned by the company CAMILLE & CLEMENTINE SAS (“Les Petits Prödiges”), a simplified joint-stock company, registered with the Paris Trade and Companies Register under number 832 784 706, whose registered office is located at 91 rue du Faubourg Saint Honoré 75008 Paris.

Les Petits Prödiges collects and processes Personal Data relating to Users on the Site.

This privacy policy (hereinafter the “Privacy Policy”) describes the methods of collection and Processing of Personal Data relating to Users of the Site and informs them of their rights.

It is supplemented by a Cookie Management Policy available below.

As a Data Controller, Les Petits Prödiges is committed to protecting the privacy of Site Users as best as possible and makes every effort to do so. Les Petits Prödiges is particularly committed to ensuring a level of protection of Users' Personal Data in accordance with the General Data Protection Regulation No. 2016/679 (“GDPR”), including all French laws and regulations implementing or supplementing the GDPR.

  1. Definitions
  • Recipient: refers to the natural or legal person, public authority, service or any other body that receives Personal Data, whether or not it is a third party;
  • Data or Personal Data: refers to any information relating to a natural person directly or indirectly identified or identifiable, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more specific elements specific to his physical, physiological, genetic, psychological, economic, cultural or social identity;
  • Data Controller: refers to the natural or legal person, public authority, service or other body which, alone or jointly with others, determines the purposes and means of the Processing;
  • Processor: refers to the natural or legal person, public authority, service or other body which processes Personal Data on behalf of the Data Controller or the initial Processor;
  • Processing: refers to any operation or set of operations performed or not performed using automated processes and applied to Data or sets of Personal Data, such as collection, recording, organization, structuring, storage, adaptation or modification, extraction, consultation, use, communication by transmission, dissemination or any other form of making available, reconciliation or interconnection, restriction, erasure or destruction.

Other words and expressions used in the Privacy Policy beginning with a capital letter have the meaning given to them in the General Terms and Conditions of Sale or in the General Terms and Conditions of Use available on the Site.

  1. Personal data collected via the Site

Les Petits Prödiges collects the following Personal Data directly from Users:

  • Identification data, such as names and first names;
  • Contact data allowing the management of Orders and/or the sending of commercial prospecting to Users (email address, postal address);
  • Data relating to Product Orders placed through the Site, such as the Product(s) purchased, the transaction number, the delivery address, the User's telephone number, etc.
  • Data relating to job applicants.

It is specified that payment information (credit card number/Paypal information/bank details) is not collected by Les Petits Prödiges but directly by the payment service providers (Paypal/Shopify Payments/Payplug/Apple Pay) used on the Site.

Personal Data collected for the execution of the User's Order, compliance with Les Petits Prödiges' legal or regulatory obligations or those that condition the conclusion of the General Terms and Conditions of Sale must be provided. Otherwise, Les Petits Prödiges will not be able to provide the Products to Users.

  1. Purposes and legal basis for the collection of Users' Personal Data and duration of Data retention by Les Petits Prödiges

The table below provides Users with an overview of how their Personal Data is processed by Les Petits Prödiges.

  1. Identification Data, Contact Data, Connection Data, Data collected during the purchase procedure carried out on the Site
  2. Identification and contact data, subject of the message and all information transmitted via the free text field

  4. Data present in the resume. All information transmitted by the User. All information transmitted via the online virtual assistant (text, photos, videos)

  1. Management and administration of the User's Personal Space, management of the contractual relationship (delivery of Products, invoicing, payment, package tracking, after-sales service, conducting satisfaction surveys)
  2. Provision of information relating to Products on the Site via the contact form, at the User's request
  3. Publication of reviews on the Site
  4. Response to a request sent via the "I apply" button
  5. Accounting and tax obligations
  6. Management of pre-litigation and litigation
  7. Commercial prospecting aimed at Users (sending newsletters), for the purpose of promoting and marketing Products

Legal basis

  1. Execution of the contract concluded between the User and Les Petits Prödiges (General Terms and Conditions of Sale)
  2. Collection of the User's consent
  3. Legitimate interest of Les Petits Prödiges in publishing consumer reviews on its Products
  4. Execution of pre-contractual measures taken at the User's request
  5. Compliance with a legal obligation of Les Petits Prödiges to retain Personal Data
  6. Legitimate interest of Les Petits Prödiges for establishing proof of a right or a contract
  7. Collection of the User's consent

Retention period

  1. Duration of the contract. Data is then archived for the duration of the legal limitation period
  2. Duration necessary for handling the User's request
  3. Duration of publication on the Site
  4. Duration necessary for processing the request and a maximum of two years in Les Petits Prödiges' CV database
  5. Legal period prescribed for the retention of tax and accounting documents
  6. Data collected during the purchase procedure carried out on the Site
  7. Duration of the legal limitation period Until the User's consent is withdrawn, and at the latest 3 years after a last active contact from the User

 

  1. Recipients of Users' Personal Data

Les Petits Prödiges does not transmit Users' Personal Data to third parties, except in the following main cases:

  • Les Petits Prödiges employees, particularly those in charge of commercial relations with Users, who are required to ensure the confidentiality of Personal Data;

Personal Data Processors, who are required to guarantee the confidentiality of Personal Data, including:

  • The service provider in charge of hosting the Site, including Users' Personal Data;
  • The service provider in charge of emailing;
  • The service providers in charge of the dispatch and delivery of Products;
  • The service providers in charge of payment services on the Site (Payplug, Paypal, Shopify Payments, Apple Pay);
  • Communication of Users' Personal Data to the competent authorities in application of applicable law and/or a court decision.
  1. Retention period for Personal Data

Les Petits Prödiges only retains Users' Personal Data for the duration strictly necessary for the purposes set out in Article 4.

Users' Personal Data is then sorted and archived, for those that have not been deleted, with restricted access for an additional period to allow Les Petits Prödiges to fulfill its legal and/or regulatory obligations regarding the archiving and retention of Personal Data. At the end of this additional period, Users' Personal Data is permanently deleted from Les Petits Prödiges' databases.

  1. Security

Les Petits Prödiges undertakes to implement all technical and organizational measures to ensure the security and confidentiality of Users' Personal Data in application of the GDPR.

As such, Les Petits Prödiges takes appropriate precautions with regard to the nature of the Personal Data and the risks presented by the Processing, to preserve the security of the Personal Data, and in particular to prevent them from being distorted, damaged or accessed by unauthorized third parties (physical protection of premises, user authentication process with personal and secure access via confidential identifiers and passwords, connection logging, encryption of certain Personal Data, etc.).

  1. User Rights

Users have a right to access, rectify, object to, limit, erase and portability of their Personal Data under the conditions provided by the GDPR.

In addition, Users have the right to define their instructions concerning the retention, deletion and communication of their Personal Data after their death, under the conditions provided by French law.

Finally, Users have the right at any time to withdraw their consent when the Processing of their Personal Data requires such consent.

In accordance with article L.223-2 of the Consumer Code, Users have the right to register free of charge on the telephone canvassing opposition list via the Bloctel service (www.bloctel.gouv.fr).

  1. Transfer of Users' Personal Data outside the European Union

Users' Personal Data may be transferred outside the European Union, particularly to the service provider located in Canada which provides Les Petits Prödiges with its Site hosting services (Shopify).

Les Petits Prödiges implements the necessary safeguards to secure these transfers outside the European Union, particularly through the signing of standard contractual clauses or through an adequacy decision by the European Commission.

  1. Amendment to the Privacy Policy

Les Petits Prödiges reserves the right to amend and/or update this Privacy Policy. The revised Privacy Policy will be posted on the Site with an indication of the last update date.
