Return and Refund Policy

All terms capitalized in this document are defined in the General Terms and Conditions of Sale.

Article 1. How to contact Les Petits Prödiges customer service?

For any difficulties, the Client must first contact Les Petits Prödiges customer service:

Article 2. What is the right of withdrawal and how to exercise it for a product?

2.1. Can I withdraw after placing an Order for a Cosmetic Product?

In accordance with articles L. 221-18 et seq. of the Consumer Code, any Client benefits from the right to withdraw, without giving any reason, within a period of fourteen (14) days, which runs from the day after the Cosmetic Product is received by the Client, or by a third party designated by them, other than the carrier.

If the deadline expires on a Saturday, Sunday, or a public holiday or day off, it is extended until the next business day.

In the event of damage to the Cosmetic Product on this occasion, Les Petits Prödiges reserves the right to deny the Client's right of withdrawal.

In the case of a Gift Card purchased on the Website, the Client also has a period of fourteen (14) days from the receipt of their Order by email to exercise their right of withdrawal, without giving any reason.

This right of withdrawal for the Gift Card is exercised provided that it has not been used in whole or in part before the expiry of this withdrawal period. Otherwise, the Client will not be entitled to any refund.

2.2. How do I notify Les Petits Prödiges of the exercise of my right of withdrawal?

The Client must notify Les Petits Prödiges of their decision to withdraw by any unambiguous statement:

  • By returning, to the postal address indicated, the signed and completed withdrawal form available in Annex 1 of this Returns Policy
  • By returning their decision to withdraw to Les Petits Prödiges by any other unambiguous means to the email address indicated in Article 1 above.

For the fourteen (14) day withdrawal period to be respected, the Client must send their communication relating to the exercise of their rights before the expiry of this period.

In all cases, the burden of proof of this exercise rests on the latter.

Article 3. How to return cosmetic products in case of exercising the right of withdrawal?

3.1 Procedure to follow

The Client must return the Cosmetic Product to the address communicated by Les Petits Prödiges customer service, in its original packaging and in a condition suitable for remarketing (products in perfect condition with their original packaging, accessories, instructions, and sealed with the safety seal...), and if possible with its original packaging. The product must be returned with the return slip, without undue delay and at the latest fourteen (14) days after the Client has communicated to Les Petits Prödiges their decision to withdraw from the electronic sales contract.

This deadline is deemed to have been met if the Client returns the Cosmetic Product before the expiry of the fourteen (14) day period.

Otherwise, no refund can be made by Les Petits Prödiges.

The return of the Cosmetic Product is the responsibility and at the expense of the Client. Any customs fees related to the return of the Cosmetic Product, especially for returns from a country outside the European Union, are also the responsibility of the Client.

Article 4. Product refunds

Les Petits Prödiges will refund the Client for payments for returned products, via the payment method used for the Order. Initial delivery costs will not be refunded. This refund takes place no later than fourteen (14) days from the day Les Petits Prödiges is informed of the Client's decision to withdraw.

Les Petits Prödiges may defer the refund of the Cosmetic Product until receipt of the Cosmetic Product subject to the withdrawal, or until the Client has provided proof of shipment of the Cosmetic Product concerned, the date chosen being the earlier of these events.

Article 5. Exclusion of the right of withdrawal for cosmetic products

In accordance with article L. 221-28 of the Consumer Code, the Client expressly acknowledges that any Cosmetic Product unsealed after delivery and which cannot be returned for reasons of hygiene or health protection cannot benefit from the right of withdrawal, particularly if the seal of a Cosmetic Product is removed (without this list being exhaustive).

In other words, only unused and unopened products can be returned and refunded.

These provisions apply without prejudice to the legal guarantees of conformity and hidden defects provided for in Article 12 of the General Terms and Conditions of Sale, which remain fully applicable.

Article 6. How to return products if they have conformity defects or hidden defects?

1.1 Procedure to follow

If the Products delivered by Les Petits Prödiges do not conform to the Products subject to the Client's Order or if they have hidden defects, the Client must inform Les Petits Prödiges by email, by contacting Les Petits Prödiges customer service, in order to notify them of the non-conformity or hidden defects.

Les Petits Prödiges customer service undertakes to acknowledge receipt of this notification sent by the Client and provides them with the instructions to follow.

From the receipt by the Client of the instructions from Les Petits Prödiges customer service, the Client undertakes to send a photo of the non-conforming Product or one affected by a hidden defect to the email address indicated by Les Petits Prödiges.

In the event of a preparation error, the Client must return the Product, if possible, in its original packaging, in its intact original condition, accompanied by the return slip, and unused (except if the Product has a hidden defect). The Products are returned at Les Petits Prödiges' expense and the risks associated with the return of the Products are borne by Les Petits Prödiges. Upon receipt of the Products, Les Petits Prödiges examines them to ascertain their conformity or non-conformity.

1.2 Content of legal guarantees of conformity and hidden defects

“The consumer has a period of two years from the delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of a conformity defect. During this period, the consumer is only required to establish the existence of the conformity defect and not the date of its appearance.

When the sales contract for the goods provides for the continuous supply of digital content or a digital service for a period exceeding two years, the legal guarantee is applicable to this digital content or digital service throughout the entire planned supply period. During this period, the consumer is only required to establish the existence of the conformity defect affecting the digital content or digital service and not the date of its appearance.

The legal guarantee of conformity implies an obligation for the professional, where applicable, to provide all necessary updates to maintain the conformity of the goods.

The legal guarantee of conformity gives the consumer the right to repair or replace the goods within thirty days of their request, free of charge and without major inconvenience to them.

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial warranty.

If the consumer requests the repair of the goods, but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.

The consumer can obtain a price reduction by keeping the goods or terminate the contract by obtaining a full refund against return of the goods, if:

The professional refuses to repair or replace the goods;

The repair or replacement of the goods occurs after a period of thirty days;

The repair or replacement of the goods causes significant inconvenience to the consumer, particularly when the consumer permanently bears the costs of collecting or removing the non-conforming goods, or if they bear the costs of installing the repaired or replacement goods;

The non-conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.

The consumer also has the right to a reduction in the price of the goods or to the termination of the contract when the conformity defect is so serious that it justifies an immediate price reduction or contract termination. The consumer is then not required to request repair or replacement of the goods beforehand.

The consumer does not have the right to terminate the sale if the conformity defect is minor.

Any period during which the goods are immobilized for repair or replacement suspends the warranty that remained to run until the delivery of the reconditioned goods.

The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the Consumer Code.

A seller who, in bad faith, obstructs the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which can be increased to up to 10% of the average annual turnover (article L. 241-5 of the Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects in application of articles 1641 to 1649 of the Civil Code, for a period of two years from the discovery of the defect. This guarantee gives the right to a price reduction if the goods are kept or a full refund against return of the goods.”
